Why are you making an issue of potential use of pardons for crimes in New York state that have not been yet charged, let alone convicted? Melber asked.
Well, in this past week, Donald Trump and his lawyers have made a series of claims, essentially saying theyre above the law, Teachout replied. What we need to make very clear, is that a presidential pardon of federal crimes will not cover all state crimes, that those associates would still be vulnerable to prosecution under New York state law.
Theres reason to believe that there would be, for many of his associates, a lot of separate New York crimes, she continued. New York has very extensive, powerful bank fraud laws, money laundering laws, bribery and larceny laws.
The President of the United States has expansive ability to pardon those convicted of federal crimes, but the pardon power for state convictions lies with the governor. Therefore if the state of New York aggressively pursues criminal charges against the president and his associates then justice will be served despite Trump pardons of federal criminal convictions.

Unfortunately, NY has a weird state law that counts Federal Prosecution as double jeopardy.

Theyve been talking about changing the law for a couple months now. Not sure what is taking this long.
In New York, Push to Bypass Trumps Pardon Power Gains Traction
After careful deliberation, I am urging the state legislature to swiftly pass legislation which safeguards against President Trumps attacks on the rule of law in our country, James said in a statement released on Tuesday morning. The pending legislation closes a loophole in our state law that effectively allows the president to pardon individuals for crimes committed in New York State.
James argued that Trumps pardon of DSouza and his recent claim that he can pardon himself are even more reason to close the loophole.
Given President Trumps recent use of the presidential pardon in a case adjudicated in New York State and his claim that he can pardon himself as he pleases, its clear that we must act now, James continued. We can protect New Yorkers from double jeopardy prosecutions without giving away our states ability to deliver justice for all.
