The only way McConnell/tRump don't get to select the next justice to the SCOTUS,

is if there are defections of at least two Republican senators who agree to caucus with the Democratic Party. That's the only way. And it has to happen really fucking soon. That would put Schumer as the Senate Majority Leader and he would be able to shut down the hearings on any nominee.

That's it. As long as McConnell runs the Senate the nominee will be approved. Period.

Sorry, not going to pin my hopes on any clown with an R after their name. If ever there was a time for these mythical sane Republicans to defect it is now.

Yeah....again I'm not holding my breath.

They just have to vote against the nominee. 51 votes against is all that is needed. No party switching necessary.

literally just before they would adjourn before the new Congressional session starts and Turtle wants to do this BEFORE the election. But they have pretty much stopped doing Recess Appointments anyway and always do Pro-Forma sessions (gavelling in every 3 days) - where they even took Obama to court all the way to the SCOTUS for still trying to do them during Pro-Formas and the SCOTUS sided with the GOP due to Pro-Formas being "their rule".

While we’re all waiting on the Mueller investigation findings, on TRMS last night Rachel’s guests Anthony Romero, ACLU and Maura Healey, AG for MA, discussed the many federal court decisions against Trump and his administration that are currently in the pipeline. One decision I did not hear them mention was the decision specifically involving Trump’s compliance (or not) with the emoluments clause, a decision which is expected in mid-July from Judge Sullivan, USDC for DC. Will Trump and future presidents be allowed to profit off their presidency? The future of our democracy depends on how the judge rules. If found to be in violation of the emoluments clause what will be the status of his authority as pResident until his compliance with the emolument’s clause --- including his authority to nominate federal and USSC judges?

If he’s found not to be in violation of the emoluments clause, is it time for Democrats to start thinking like Republicans? In accordance with the Constitution Democrats say that the USSC shall be comprised of one Chief Justice and eight associate justices. Republicans, on the other hand, say that they can increase the number of USSC associate justices without violating the Constitution since an increase in the number of justices does not violate the Constitution’s nine judge requirement as there’ll still be (at least) nine justices on the court.

See Article III, Section 1: "The judicial Power of the United States shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish." That's all it says about the creation of the Supreme Court.

while voting in lockstep with Ted Cruz and then acting surprised when the "promises" made to her by Republican leadership are ignored.

McCain is dying and he's a solid Republican when it comes to things like SCOTUS nominees. Ditto Murkowski and others.

There is literally no one in the GOP to pin our hopes on.

Why bother forcing your most vulnerable members to go down with the ship when there is no benefit?

Without either a majority or the filibuster, Democrats are just spectators.

Trump already has made fun of McCain..in nasty evil ways. Flake's seat is up and he is retiring..If.that is IF, he and McCain switch to our side and hang in there till January, and if we win big in November and take 3 or 4 more Senate seats then, and only then............McConnell will be stopped.....

Repeat ....If McCain and Flake switch to our side NOW...and they can..., and if we take 3 or 4 more Senate seats in November..............then McConnell will be stopped, and I got to add this
