An Uber passenger was fatally shot after an argument with the driver about a "large amount of vomit" in the back seat of his car, the police say.
James Porter, 27, was shot dead by the side of a New Mexico highway on March 17, the Albuquerque Journal reported.
The Uber vehicle's driver, Clayton Benedict, has not been charged with a crime in connection to the shooting, the Journal said.

According to the Journal, Benedict told the police that Porter and Reyes had been drinking and that Reyes vomited on the back seat. The incident is said to have sparked an argument over a clean-up fee, which the affidavit said Porter refused to pay.
Benedict said he pulled over at an interstate exit and asked his passengers to leave the car, the Journal said. He said Porter reacted angrily, slamming the door and throwing his sunglasses at the driver, who had also exited the vehicle.

(37,748 posts)I suppose "sounds like he was an asshole" is a wonderful excuse to both minimize and trivialize the death of others, allowing us to justify our basest and most crass emotions as somehow rational.

(706 posts)Porter had no problem trivializing the potential death of the uber driver when he tried to commandeer the car and threaten to run over him (kill him) with it.
It's rarely the small little argument that happens that gets someone killed, like the headline in the OP. It's what happens right before the shots are fired that matters. Being a drunk asshole and puking in the car didn't get Porter killed. Trying to steal the car and threatening to kill the driver is what got him killed.
I don't know if it was a good shoot or not. I wasn't there. None of us were. Maybe it was, maybe it wasn't, but it wasn't as simple as the OP headline makes it seem.

(3,145 posts)Drunken jerk made a threat to commit a violent felony against the driver - "Well if youre not going to shoot me, I (am) going to run you over with your own car".
Following that threat, Drunken Jerk actually tried to access the vehicle which escalated the incident from a threat to an attempt which brings self defense into play.
Do you really think that if the police believed it wasn't justified they would have released him without charge?
Drunken Jerk is pushing up daisies due to his own actions.

Don't expect the justice system to have your back if you escalate an argument. Our country is insane.

But, it basically says uber man shot the guy because the dead guy went to the car's open driver's door and said "Well if you're not going to shoot me, I (am) going to run you over with your own car." To me, if that's all that happened, that doesn't get uber guy out of some sort of charges.
However, if the guy that got shot was actually in the car, and taking action to back up his threat, I think uber guy is in the clear. If there isn't any evidence to disprove his story, he's not the one that needs video (even though his story could be made up). He doesn't have to prove his story...the Prosecutor has to disprove it.
