(15,290 posts)Pence has no role in the trial. The CJ is the presiding officer of the Senate during the trial meaning he could rule if he chose to do so. However, I expect Roberts will remain neutral. The Supreme Court has cases working there way up that are pertinent to issues being argued by both parties. I suppose it's possible that if Roberts would break a tie, lawyers arguing the relevent cases before the USSC might ask him to recuse himself.
It will be fascinating to see what Roberts takes away from all he has seen and heard presiding over the trial and that plays a role in future court decisions.

(2,305 posts)The legal precedent from the Andrew Johnson trial is that a tie vote then goes to the presiding officer, usually the VP but in this case, the chief justice.
So, would Roberts follow precedent of one of the respected CJ or will he be a rethug stooge. My guess sadly, is that this is how the democracy dies. He chooses party over legacy. Of course, since winners write history books, he may think that he will be on the right side of history just like Putin, Stalin, Pol pot, and all the authoritarian leaders who believed the Nazi adage that you can change all of public perception in just a few years by controlling the media and the schools.

(11,885 posts)And is now compromised also ? Should he have recused himself ? I do not trust him to be honest , and will refuse to do whats right now. Has Roberts been corrupted with all the other republicans in Congress now? Democrats needs to look into this.
