The D.C. Circuit Court of Appeals gave the Trump administration until May 11 to seek a stay from the Supreme Court, denying the DOJ's request for a longer stay. The order was set to go into effect on Friday.
The move essentially leaves it up to the Supreme Court to decide whether to halt the order to hand over the materials.
The Justice Department had told the court that it intends to petition the Supreme Court to hear the case after a D.C. Circuit panel ruled that the House Judiciary Committee was entitled to the sealed materials as part of its impeachment inquiry.

Roberts has to decide whether he wants to enter history as the Chief Justice who did more harm to the United States than even Taney, or uphold the rule of law against a traitor, and do what he can at this late date to save the Republic....

(23,166 posts)He's just as much a fascist enabler and constitution destroyer as all of the other 4 Russian Repug SCOTUS (in)justices. Don't read his articles, watch his votes which have never hurt went against the oligarchs. He's putting through anything drumpf wants as a priority hearing but stopping the appeal courts verdicts against drumpf and delaying hearing those as long as possible. He was included in RBG's dissent, she sees no difference between him and Alito or Thomas when it comes to politics.
