(7,447 posts)Half the states don't have a "Romeo and Juliet" law so an 18 year old can in fact be charged with statutory rape in many states for having sex with a 17 year old if the AOC is 18 for example.
I think we should decide as a nation a universal AOC as the variations from 18 to 17 to 16 don't really make sense.
I also am not really in favor of Romeo and Juliet laws. Either they can consent or not. Why should it matter if the partner is only a year or two older? If they can't consent, they can't consent. Period.
How do you solve that? You could lower the age to say 17 or 16, which is the age in many states. 14 is definitely too young.
I'm also not sure the power dynamic between a 40 year old man is any less with an 18 year old girl than a 17 year old girl.
I get it. Teenagers have sex. We, as a society, really don't want a string of 18 and 17 year old boys being registered sex offenders and rapists because they have sex with a high school classmate who is a year or two younger. Particularly when our, quite frankly sexist, societal preference has women "preferring" older partners. It's ingrained.
But at the same time, if we think a 16 year old can't consent, it shouldn't matter that she couldn't consent with an 18 year old or a 40 year old. If you want to address the difference, it's more properly done in sentencing, make it a misdemeanor with no sex offender registration for example if you are within x number of years in age.
