(2,896 posts)Whether an offer is made with the intent to deliver (i.e., not a joke) is not in the slightest degree dependent on the likelihood that the offer will be accepted.
If this doesn't clear it up for you, let me know and I'll see if I can find a better way to help you understand.
It is, of course, a joke in that--as you have with punctilious accuracy identified--it is intended as a bit of a tease in the direction of Mr. Justice Thomas.
Humor is funny that way (no joke!); there can be two things going on at once, and it actually makes the humor even more better!

(25,930 posts)Biden would not get to appoint a new justice. Republicans would simply refuse to confirm anyone, so close (9, 10 months) to an election they're convinced they will win. They did that with Obama a year out. Then they confirmed a Trump nominated justice twenty minutes before he left office.
Oh, the hypocrisy.

No recusal guidelines, no official, binding rules on gifts.
At this point, Clarence Thomas or any of the others could blatantly say "I will be deciding this case based on the interests of my patrons." and no one could do a single freaking thing.
Yeah, those robes should have patches on them to designate who they are owned by...the one thing we know for sure is that six of them would have zero patches that say "the people of the United States".

This was a suggestion from RainCaster and I think they are onto something there.

I'm sick over the fact that the Supreme Court has zero responsibility to anyone but their various benefactors...all of whom can outbid us.
