Golden Gate Bridge protesters may owe restitution under Masy's law if convicted

Legal analyst Steven Clark gave his thoughts on Jenkins’ comments Wednesday.

"Brooke Jenkins recognizes that there is a right to free speech, but at the same time you have to do that in a lawful way,” he said. “And I think that by saying she wants people to come forward, she want's community involvement in this prosecution."

Clark added Jenkins isn't just trying to respond to a frustrated public. Under California Marsy's Law, victims of crimes can be awarded damages by people who are convicted or plead to those crimes.

"So, if there is a conviction or another diversion agreement, Marsy's Law will be able to provide restitution to anyone who suffered economic loss as a result of those protests on the Golden Gate Bridge,” he said.

Trapped for hours on a bridge with no bathrooms and no way off, I think there will be some convictions, maybe the restitution they pay will make others think twice about blocking traffic.

There is no reasonable expectation that your actions are not without personal risk.

You are responsible for your actions. If you don't want risk, follow the law.

But civil rights activists have been willing to trade the risk of personal safety to protest in the past.

What they haven't been willing to do is risk public safety. If you risk public safety, f you.

Because over the years they've watched people pulling similar stunts in the Bay Area get off with wrist slaps so gentle, they're almost erotic in their tenderness. The Bay Bridge protest - one that delayed transportation of a donor organ for a start - resulted in five hours of community service and a fine.

I think actual consequences would be a very rude awakening for some of these protestors.

One I sorely hope they have. People are sick of this.

And kudos to Brooke Jenkins. Since the day she's taken over from Boudin, she has been extremely good at reading the public mood. I'm a fan.

Blocking donor organs goes over the line, and before someone comes at me with „how could they know?“ I say, „how could they possibly rule it out?“

Although, if somebody died on the operating table waiting for a transplant organ stuck on the bridge due to the "protest," I would no longer take being thrown from the bridge off the table.

Damages will be awarded under California's victim restitution laws.
