Will they decide they need to send it back to chutkin for determination of facts that are missing, such as were specific acts official or campaign events, and then return for a final vote.

That would push the dc trial out beyond the election for sure.

A 9/0 decision to deny total immunity is a dream unattainable with this court. The in-the-bag for Trump Justices will insist on more finding of fact because it’s a plausible excuse for more delay. Their apparent skepticism of total immunity is designed to preserve whatever legacy of legitimacy they have.

It appears the conservative Justices don’t just want to send this back to the appeals court, they want it to go all the way back to the district court. Now THATs delay.

Justice Sotomayor just brought up the hypothetical example of the President ordering the military assassination of his opponent, and trump"s lawyer had NOTHING to refute the ridiculousness of that scenario.

This should be over immediately.
What a preposterous idea.






Sotomayor channels Florence Pan's famous "navy seal team 6" question in DC Circuit. what if Pres orders the military to assassinate someone for personal gain rather than protecting the country? How can it be that deserves immunity?
