Not a lawyer, but most court observers on MSNBC would agree. Roberts will have to thread the needle for the rest when he writes their decision to kick it back to Chutkan, then later, when they get new district and appeals rulings on this case to do their thinking for them. Then follow or ignore as the presidential election helps them decide.
Were the court to let assassination be an official act, and done before Jan 6 2025, the nation would be rid of Trump forever. Yeah, I said it.

But it could also work in reverse. Their hate and arrogance blinds them to that possibility.

Somebody should point this out to SCOTUS, to put it in the record and to make them think about what presidential immunity really means. Every time I remember of some of the arguments being made today, I turn into a sputtering mess. It's so upsetting.
