The other shoe drops - I'd love to be a fly on the wall of Scalia's office today. Nearly every judge striking down state ban on marriage equality referred to his dissent in Windsor:
"As far as this Court is concerned, no one should be fooled; it is just a matter of listening and waiting for the other shoe.
By formally declaring anyone opposed to same-sex marriage an enemy of human decency, the majority arms well every challenger to a state law restricting marriage to its traditional definition, Scalia wrote.
In Utah, Ohio, Virginia and Kentucky, federal judges fully embraced Scalia's predictions last year in his dissent in United States v. Windsor, the case that struck down key portions of the federal Defense of Marriage Act. Scalia wrote in that dissent that he believed the majority's logic would inevitably lead to other judges striking down same-sex marriage bans.

I read that in the Texas decision, the Judge even referenced a Scalia dissent in 2003 where he admits "traditional marriage" is just a nice way of saying a marriage that is morally approved of. And since the court established in the DOMA ruling that moral outrage isn't a good basis of law, I'd say that sour old fugger is screwed.
