The mother of 5-year-old Payton Benson didn’t want her child’s killer to receive life in prison for the crime.

Speaking on behalf of mother Tabatha Manning, a prosecutor told Douglas County District Judge Marlon Polk on Thursday that Manning had forgiven Vincent Hicks and that she was thankful he had pleaded guilty instead of letting the case go to trial.

A dry-eyed Manning was in the courtroom and quietly watched the proceedings unfold.

“She does not feel he deserves life” in prison, prosecutor Tressa Alioth said.



Payton Benson was killed by a stray bullet in January 2013.

It takes a very strong person to be able to forgive, and a wise one.

Seeking revenge is for the weak.

She can hold her daughter in her heart without the burden and distraction of living a life of hatred.
