ghouliani was on cnbc earlier saying that the doj should prosecute anyway, notwithstanding comey's recommendation not to.
obviously partisan crap, but as a matter of formality, i don't think the fbi has the final say on this.
granted, it would seem like all the more of a partisan smear campaign if some republican career prosecutors decide to indict anyway after comey said "no reasonable prosecutor would".
but since when have republicans been known for being reasonable...?
i imagine the doj wouldn't normally comment on a decision not to prosecute, but they might well in this case. let's hope that happens soon.

(44,276 posts)Wow not correct, the department of Justice has the final say. The FBI did the investigating and only recommended that Hillary Clinton not be prosecuted. Ms. Lynch did say the justice department would follow the FBI recommendations.

i'm not taking ghouliani's comment as any authority, i'm simply taking it as proof that the media won't shut up about it.
until the doj itself says they won't prosecute, the media and republicans will keep this b.s. story alive.

Sadly, this will never disappear for the next 8 years because the GOP will notice let it die. That said, it will not be headline making news but it will be talked about and the media will report on it.

(10,164 posts)The issue isn't the potential for an indictment at this point...it's in the fact that Comey condemned her actions and judgement in about the harshest possible way he could short of recommending indictment. He basically handed perfect attack ad fodder to Trump. That's not a trivial matter.

But still, at the end of the day, attacking Hillary over her private e-mail server, while it will nonetheless be ongoing fodder for wingnuts, won't put food on (most) people's tables or more money in their pockets, solve global warming, end police brutality, etc. IOW most people not already predisposed to vote against Hillary didn't, don't, and won't care about this in the long-term IMHO. The only time this would be a story is if the FBI recommended indictment. The story- to the extent that most people knew or care about it- will die outside right-wing circles. And Trump is seriously the LAST person anybody with half a brain would trust with classified information, let alone "the button".
