A man admitted he surreptitiously took cellphone video up a woman's skirt while she shopped at a grocery store, but a Georgia court said he didn't break the law.
A divided Georgia Court of Appeals this month tossed out the conviction of former grocery store employee Brandon Lee Gary, who recorded videos up a woman's skirt known as "upskirting" while she shopped. The 6-3 majority opinion said Gary's behavior, while reprehensible, doesn't violate the state's invasion of privacy law, under which he was prosecuted.
In a ruling issued July 15, Judge Elizabeth Branch said it is "regrettable that no law currently exists which criminalizes Gary's reprehensible conduct."
"Unfortunately, there is a gap in Georgia's criminal statutory scheme, in that our law does not reach all of the disturbing conduct that has been made possible by ever-advancing technology."

(35,390 posts)This is the kind of thing that can be handled by a community without criminalization. However, since we're not part of a decent community anymore, that means peers and relatives can't enforce morality and a social code.
In fact, this guy's "community" probably thinks it's a funny or even cool thing. His community may consist of a few guys he knows and 30k on the Internet. He may not give a damn about those around him, because our geographic communities are often fractured.
What's left is criminalizing things.

(25,406 posts)I think the legislature got its act together pretty quickly to pass a new law banning this kind of thing. I would expect that Georgia will do the same thing.

(82,849 posts)Maybe if state legislatures spent a little more time on fucknozzles like this, and less time passing unconstitutional restrictions on voting, people might think their state lawmakers were worth more than a plugged nickel. Or is that the whole idea?
Oregon had a case where the nice neighbor guy installed a hidden camera in a girl's bedroom. He got off with a slap on the wrist, but the legislature got working on it right away. The next creep will be facing felony charges.
