Think about option 3. I actually think that is one possible outcome, not by design, but as an unintended consequence.

(63,927 posts)on the Court are reckless to the extreme and they will stop at nothing to get rid of "Obamacare."
The RWingers on the Court are zealots and they are hellbent on destroying the Welfare State. They are relentless and cruel.
The only way I could imagine not overturning the mandate is a scenario where the insurance companies persuade the justices that an overthrow might likely lead to Single Payer and they would lose their industry and we would get socialized medicine faster. I can only hope that is indeed the case, even tho I would LOVE to see us have Single Payer.
I am taking a depressed view of what is going to happen tomorrow...

(24,692 posts)could strike down the whole thing). Then a public option or Medicare for all becomes the only constitutional ways to mandate coverage. That will obviously go no where in the House any time soon, but after the election, who knows.

It goes nowhere in the Tea Party House, but it slowly gains popularity in the public as Democrats go on the offensive in the ensuing weeks. Obama embraces the idea a few weeks before the election, and Democrats win back the House and keep the Senate as Obama beats Romney by a comfortable margin. Harry Reid changes the filibuster rule to only require 51 votes to pass anything. House Democrats proceed to pass a Medicare-for-all bill, which narrowly passes the Senate. Obama signs the bill, and Medicare-for-all is made a reality.
This is wishful thinking more than anything, of course.
