3. Looks to be 5-4 with Roberts joining the left of the court on it being a tax.

Just now: "The bottom line: the entire ACA is upheld, with the exception that the federal government's power to terminate states' Medicaid funds is narrowly read."

I just saw a tweet about it being 6-3, which does make more sense. But Amy Howe of SCOTUSblog said Roberts joined the left and that doesn't usually describe Kennedy.

More:

"Tom: Chief Justice Roberts' vote saved the ACA."

That sounds 5-4 to me.
