The United States Justice Department said it will not prosecute Attorney General Eric Holder for contempt of Congress.

"The Department has determined that the Attorney General's response to the subpoena issued by the Committee on Oversight and Government Reform does not constitute a crime, and therefore the Department will not bring the congressional contempt citation before a grand jury or take any other action to prosecute the Attorney General," the Deputy Attorney General told House Speaker John Boehner in a letter.

As we reported, the House voted that Holder was in contempt of Congress for failing to turn over documents related to the gun-walking operation "Fast and Furious." The White House has claimed executive privilege on the emails and documents, saying they show internal deliberation after the program became public.

The AP reports that this means Holder's own department will do nothing further on matter.

I put their real positions on sex and all things as part of seeing people as objects or commodities. Disposable things. There was a meme going around for a while:

People were created to be loved. Things were created to be used.

The reason why the world is in chaos is because things are being loved and people are being used.


That is part of the problem with them. The quote is an anti-materialist rant that might apply to everyone. We like owning things because we can use, abuse and discard them. But Thoreau said they end up owning us. Same thing with people.

"The longstanding position of the Department of Justice has been and remains that we will not prosecute an executive branch official under the contempt of Congress statute for withholding subpoenaed documents pursuant to a presidential assertion of executive privilege," says Deputy Attorney General James Cole in a letter to the House speaker, John Boehner.

The letter notes that during the Reagan administration, DOJ took the position that the contempt statute could not constitutionally be applied to an official who asserts the president's claim of executive privilege. That policy was first articulated in a memo written by Ted Olson when he was at DOJ in 1984.

Cole writes that the position has been asserted several times since then, most recently during the Bush administration in 2008 ...
