How is it that it took 60 votes to pass the ACA but only 51 votes to repeal it?

Can someone explain that process?

It seems that when the Democrats were in power, the Republicans required 60 votes to pass anything, no matter how trivial.

But now, the Republicans want to repeal the law that they required 60 votes to pass but they only need 51 votes?

Is the Democratic Party unable to play the same game as the Republicans? Are the Republicans that much smarter than the Democrats?

It doesn't make sense.

1. Esoteric reconciliation rules, which actually came into play when the aca was first passed.

The original law passed cloture with 60 votes, but there was a "fix" passed a week after the aca under reconciliation laws after we lost Ted kennedy.

But, after September 30th, they cannot use reconciliation?

5. Reconciliation only applies to some budget-related laws

So a federal law addressing a social issue, criminal law, voting rights, etc. wouldn't qualify for reconciliation and so would need 60 votes.

I think even budget legislation only qualifies if it first in the annual budget. Aca didn't, so it didn't qualify. Repeal does, do it does qualify.

Reconciliation expires at the end of the budget year, which is September 30.

But then they'll get to work on a new budget and potentially they'll make room for aca repeal again, and we'll have the same fight in another few months after the next budget passes....

That's why they can't completely eliminate Obamacare. It is supposed to be a budget adjustment to the law, not outright lawmaking. After Sept 30 reconciliation isn't available anymore and Dems will be able to filibuster any changes to the law.

You kinda have to control the White House, the House of Representatives, and between 50 and 59 votes in the senate before it makes s new to use a his procedure.

We haven't been in that position much lately.
