Husband in runaway mom-daughter case arrested in Atlanta

CONCORD, N.H. (AP) — The husband of a woman who fled New Hampshire with her 8-year-old daughter a decade ago amid a custody dispute in a previous relationship was arrested on Wednesday as he landed at an Atlanta airport on a flight from Central America with the daughter, the U.S. Marshals Service said.

Scott Kelley, who is not the father, was taken into custody at Hartsfield-Jackson Atlanta International Airport as he arrived from Costa Rica, said Jim Joyner, supervisor of the marshals' Southeast Regional Fugitive Task Force. Kelley is charged with custodial interference.

His wife, Genevieve Kelley, faces trial next month on the same charge.

Genevieve Kelley's daughter and Scott Kelley's stepdaughter, Mary Nunes, now 19, was with him on Wednesday, but there were no warrants for her arrest and she was released, Joyner said.

It says in the article that she will be testifying on her mother's behalf.

Given that the mother gave up her medical practice to flee with her daughter, and turned herself in to police when her daughter was 18, I think the mother might have a good case for what she did.

We'll see.

Kelley, who disappeared with her daughter in October 2004 amid an ugly custody battle with the girl’s father, resurfaced last month when she turned herself in without warning at a New Hampshire courthouse.


Now free on bail after three weeks in jail, Kelley is living in New Hampshire with her 9-year-old son. She awaits trial on charges of interfering with the custody rights of her daughter’s father.

Speaking publicly for the first time since she reemerged after a decade on the run, Kelley, 50, said she surrendered because a son born while she was a fugitive needs medical care. That child, John, was diagnosed with cystic fibrosis.

Kelley, a family practice doctor before she disappeared, said her family’s 10 years underground were difficult at times. But she said she never regretted her decision, and some of the stress of being a fugitive “fades away and you’re just living your life.”

Are they supposed to charge her with kidnapping herself?
