State appeals court blocks EM repeal question from Nov. ballot

Lansing The Michigan Court of Appeals has blocked a repeal of the state's controversial emergency manager law from being placed on the November general election ballot.
In a decision Friday afternoon, the Court of Appeals ruled organizers of the ballot initiative had "no clear legal right to certification of the referendum for placement on the November 2012 ballot" because the font size on the signature petitions was too small.
State law requires voter-initiated petition drives to have a 14-point font. Organizers of the referendum on Public Act 4 did not get prior approval of the Board of State Canvassers before distributing the petitions this winter and spring.
In April, the four-member Board of State Canvassers deadlocked 2-2 along party lines on whether to let the referendum go forward.

LANSING The petition drive to seek a referendum on Michigans controversial emergency financial manager law took another strange twist today as a state appeals court panel ruled that it should go on the ballot, then stayed its own order to poll the entire appellate bench on whether to review the issue further.
The three-judge panel, in a unanimous decision, said existing case law requires them to support the group Stand Up for Democracy and order the Board of State Canvassers to put the issue on the November ballot. But the court said they believed that, but for the precedent, they would have found against Stand Up for Democracy for failure to comply with a technical type-size requirement.
The rarely-used procedure ordered by the court calls for a poll of all 28 members of the Court of Appeals on whether to appoint a special panel of 7 judges to resolve the dispute.

(7,404 posts)It doesn't say how long the 28 Judges on the Court of Appeals have to answer back. Depending on the outcome of that, the 3-Judge panel then appoints a special 7-Judge panel to resolve the dispute. Obviously, it will take this 7-Judge panel time to study the issue from scratch. The only thing to resolve, it seems, is how absolute the font size requirement is. Question, have other issues gotten on the ballot in the past with an improper font size and how important would that be in the final ruling?

Now, we should take this as a lesson ... one I, as an African-American, have learned, and have taught my daughter ...
The Powers That Are has NO love for me/us, so we have to make damned sure every "I" is dotted and every "T" is crossed ... if we fail to do that, there really is only so much complaining that we can do.

(53,661 posts)Good thing you're making sure your daughter doesn't get her heart broken in this world believing everything is cool.
And this thing with the font size... The issue is the will of the people... Which they are simply slapping people in the face with... I don't understand what is going in Michigan, although this may be fallout of the job losses from decades ago... People there have been beaten down for a long, long time.
Do not spend any money in Republican business or with their supporters.
I have ostracized Republicans from my life.
It's nice to have that anger & hate out of my life.
Now that's change!
I'm sure there are those that can find excuses to not take these actions.
