Consumer Financial Protection Bureau Director Richard Cordray on Friday appointed the agency’s chief of staff, Leandra English, as the CFPB’s deputy director, establishing her as his successor when he steps down at the end of the day.

The move appears designed to thwart any move by President Donald Trump to name another temporary official to head the controversial agency. Trump has been reported to be considering White House Budget Director Mick Mulvaney for the role.

The 2010 Dodd-Frank Act, which created the CFPB, explicitly says the consumer bureau’s deputy director shall “serve as acting Director in the absence or unavailability of the Director.”

Trump will likely now have to nominate someone who must be confirmed by the Senate before he can oust English.

I was sad when I saw he was retiring, knowing all the good work he and his agency have done in the face of an increasingly hostile political environment. This is just proof that he was the right man for the job, his due diligence to provide the maximum protection he could for the populace is another mark in his favor.

Is Cordray retiring to run for elective office?

I live in Cordray's hometown and he's has my respect for a looong time into the future for this as well as all he's done to help consumers

Mulvaney once referred to the agency as a "joke".

They're two different concepts.

When you say someone is absent or unavailable in this context, there's an insinuation that the person still 'has the job', but they are temporarily indisposed from being able to carry out their duties.

Further backing that reading of the law is the use of the word 'Acting' ... which also implies a temporary status rather than 'taking over the job'.

I think the law might have to explicitly say that if a Director leaves/retires, the Deputy automatically becomes the Director ... for us to win the case in court. Esp. if the court deciding the matter ... is already right-leaning ...
