Virginia court rejects Democrat's bid in tied state House race: media

WASHINGTON (Reuters) - A Virginia recount court on Wednesday rejected a bid by the Democratic candidate in a disputed state House of Delegates race to reconsider its ruling that the election had ended in a tie, Washingtons WTOP radio reported.
The Newport News Circuit Courts decision means that a lottery-style drawing will go ahead as planned on Thursday to determine the winner of the race between Democrat Shelly Simonds and Republican incumbent David Yancey.
Republicans hold a one-vote margin in the 100-seat House. If Simonds is picked, the chamber would be split 50-50 and force lawmakers into a rare power-sharing arrangement.
A recount had shown that Simonds won the Nov. 7 election by one vote, but judges ruled that a disputed ballot should be counted for Yancey. Simonds then filed a lawsuit asking the judges to reconsider.

That ballot was chosen because, well, that was the ballot that was challenged by the plaintiff. Of course the choice of ballot was biased toward the plaintiff--what fool would pick a ballot that would have helped his opponent?

(43,505 posts)The ballot in question is ambiguous. Depends on which legal rule on ballots is applied, or whether the voter was just voting a straight GOP ticket, and even some of those have slashes through them.
Who was legally empowered to determine the ballot? That is the question. Did the election commission empower the 3 judge panel? Did they have the authority to delegate that duty? Does the panel have the power to do anything other than confirm or deny the count in its entirety?
I don't think some of those questions are answerable. I don't think the Democratic candidate had the best legal advice.

(15,401 posts)I think what is most tragic about this entire election is that the Democrats won the statewide race by almost 11 Percentage Points, but due to the way the Retrumplicans drew the districts, they still split the Legislature either 50-50, or 51-49 in their favor.

(17,127 posts)I thought it was 1 vote lead for the Dem. THEN the panel decided the ballot that they threw out should NOT have been thrown. (this was a ballot marked for a repb, which made it a tie?

(12,344 posts)The ballot was thrown out based on the agreement of the dem and repub watchers. Challenges are only allowed during the recount. Then the final count was made and dems won by one vote. Then the republican had second thoughts after the time to make a challenge had passed. IMO it's too late. You can't wait for the final count then go back and look for ballots you wish you had challenged if you don't like the outcome. If one ballot gets a second chance, why don't they all? How many chances do you have to get the outcome you want?
