Trump refuses to commit to Mueller interview

Source: The Hill

BY JORDAN FABIAN AND BEN KAMISAR - 01/10/18 03:37 PM EST

President Trump said Wednesday it is “unlikely” he will have to sit down with special counsel Robert Mueller for an interview, arguing that there was "no collusion" between his campaign and Russia.

Trump repeatedly dodged whether he would submit to an interview with Mueller by citing his claim there was no collusion during the 2016 presidential election.

“We’ll see what happens,” the president said when pressed by a reporter on Wednesday. “When they have no collusion … it seems unlikely that you’d even have an interview.”

Trump was speaking during a joint press conference alongside Norwegian Prime Minister Erna Solberg following a meeting at the White House.

In the end, muehler can send him a subpoena. But in reality, he wants it to be voluntary under conditions that work for the prosecutors.

If trump digs in his heels, it will probably go to the scotus eventually. But he can also just plead the fifth right in the white house.

It's a dance of the clowns against the professionals.

Are police officers going to march into the Oval Office and carry him out in handcuffs? Not likely. The only remedy would be to impeach then prosecute. But it’s even less likely that the Republican House will vote to impeach and a Republican Senate convict. We’re stuck with this bombastic loon for the forseable future.

(I’d love to be talked down from the ledge on this one, but the times seem so bleak.)

On edit: I reread your post and see you already addressed the “what if”. I’m still not encouraged, though.

If he refuses, the ball is in muehlers court.

Bob can ignore it and move forward, indicting or leaving him an unindicted co-conspirator. Ih he indicts trump, it could end up at the scotus.

Or, he can subpoena trump. Then it will go to a federal court. Eventually it could end up at the scotus.

The 2018 scotus is much different than the 1972 scotus (gawd I feel old having spanned both). Today's court has a majority of originalists. Only roberts is a question. It is likely they won't allow either an indictment or a subpoena. But that's just a guess.

This has to end politically. It won't end via the judiciary. Not in 2018.

Does Mueller have the authority to compel Trump (with a subpoena) to testify under oath?

Would Trump's refusal to appear be grounds for impeachment?

Trump declines to say whether he would sit for interview with Mueller’s team

By Josh Dawsey January 10 at 3:47 PM

President Trump on Wednesday declined to say whether he would grant an interview to special counsel Robert S. Mueller III and his team, deflecting repeated questions on the topic by saying there had been “no collusion” with the Russians during the 2016 presidential campaign. “We’ll see what happens,” Trump said when asked directly whether he would sit for an interview with the special counsel.

Trump then questioned why he would be interviewed, arguing again there had been “no collusion” between his campaign and Russia.

“It seems unlikely you’d even have an interview,” Trump said during a news conference at the White House with Norwegian Prime Minister Erna Solberg.

Mueller’s team told Trump’s lawyers in December they are likely to request an interview with the president, The Washington Post has reported, as part of their investigation into Moscow’s meddling in the election and whether any Trump associates conspired with Russian agents.

When the subpoena comes in, his ass is going to do something - whether it is a deposition or testimony in front of a Grand Jury or whatever he is told he better do.

Trump and RICO

For months, the suggestion that President Trump’s campaign and/or The Trump Organization would be pursued under RICO was largely treated as the fevered imaginings of fabulists hell-bent on removing Trump from office. However, the interlocking web of alleged criminality that Mueller is investigating bears a strong resemblance to exactly the kind of organized criminal activity that the RICO statute was designed to combat.

The U.S. Marshals are the ones who'd serve the warrant(s).

This may come down to an Andrew Jackson moment when he said, "John Marshall has made his decision, now let him enforce it."

Visit the Mueller team....under oath.....or take the 5th.

The rat is backed into a corner. Bill Clinton decided not to force constitutional crises and testified before the grand jury in 1998, so there is precedent.
