Pennsylvania GOP leader tells state supreme court he will defy its anti-gerrymandering order

On January 22, the state supreme court struck down the states gerrymandered congressional maps maps which enabled the GOP to win 13 of the states 18 congressional districts even in years when Democrats won the statewide popular vote. That order explained that the states maps must be composed of compact and contiguous territory and must not divide any county, city, incorporated town, borough, township, or ward, except where necessary to ensure equality of population. It also gave the legislature until February 9 to draw new maps, and the governor until February 15 to approve the maps and submit them to the court for review.
[...] Four days after its initial order, on January 26, the court issued a subsequent order requiring the legislature to turn over certain data including geolocation files that contain the current boundaries of all Pennsylvania municipalities and precincts and various reports analyzing how well the legislatures proposed new maps comply with the courts January 22 order.
In a letter from his legal counsel, Scarnati explicitly refuses to comply with the second order. Though the letter claims that the General Assembly is currently advancing bills aimed at creating an alternative map, the letter also states that Senator Scarnati will not be turning over any data identified in the Courts Orders.
Scarnatis stated reason for this defiance is his belief that the courts January 22 order violates the U.S. Constitutions Elections Clause. Last week, Scarnati sought a stay of the January 22 order from the Supreme Court of the United States, claiming that only the state legislature and not the state courts are constitutionally allowed to weigh in on questions of gerrymandering. The U.S. Supreme Court has not yet ruled on this stay request, which means that both the January 22 order and the January 26 order remain binding upon Scarnati.

(51,296 posts)I banged my head on that brick wall with many state agencies in Missouri. I would find various elected officials breaking the rules, call the state and get told ... we make the rules, but cannot enforce them.

And he didn't show up...so, now Republicans feel they can ignore anything that comes from the courts. So far, the man-child, knowingly (I am assuming he understands the criminality of his actions, but I could be wrong) has committed "Obstruction of Justice" actions, continues to do it and still getting away with it, he continues to sign on horrible bills, continues to lie, tweet, etc. etc.
Same with Ryan, McConnell, etc. etc. So why would it be that other repubs would not believe the can get away with stuff like that as well?
Until the courts start making these people accountable for their actions, penalizing them, they will continue to challenge the courts. Its just like little kids, they challenge their parents until they finally get the punishment to finally realize their parents were not playing games.

Does have a pretty decent Democratic governor. It would be interesting to see if he had the ability to, if he could take action.

(1,020 posts)Maybe the reason they don't want to release the data is because they then have zero wiggle room. By not letting the court see the data, they may have some wiggle room to avoid "going to college".
(The Chicago mob calls jail "college" because that's where you really learn what's what...)

(15,307 posts)I mean, the state Rs have become more rw over the years, but there are still a good chunk of Rs who can and do work across the party aisle.
I do know the Rs fought and fought to not release their data to the lower court. This shows they must be know the data will show how they illegally packed and cracked voters into various districts. The court has 5-2 Dem majority and I don't honestly see the 2 R justices going along with Scarnati. I think he'll be held in contempt.

(15,307 posts)to the GOP legislators, but I don't know for sure. The data itself probably was derived from public data like voting rolls, census tracts, etc but the the Rs must consider they way they used it to pack and crack is proprietory.

(11,152 posts)that Sen. Scarnati appear to show cause why he should not be cited for contempt. If he does not appear as ordered, I would expect the Court to send the State Police to take him into custody and hold him in jail until the Court's next sitting.
