Trump administration moves to block victims of gang violence, domestic abuse from claiming asylum

Atty. Gen. Jeff Sessions has ordered immigration judges to stop granting asylum to most victims of domestic abuse and gang violence, a move that would block tens of thousands of people, especially women, from seeking refuge in America.

The decision, which immigration advocates are sure to aggressively fight, came as Sessions seeks to use the authority of his office to sharply change U.S. immigration law to make it less friendly to asylum seekers.

The attorney general has the power to issue decisions that serve as binding precedents for immigration judges. In this instance, he used a case involving a victim of domestic violence to rule that survivors of such “private” crimes are not eligible for asylum under U.S. law.

“Generally, claims by aliens pertaining to domestic violence or gang violence perpetrated by non-governmental actors will not qualify for asylum,” Sessions wrote in his ruling. “The mere fact that a country may have problems effectively policing certain crimes—such as domestic violence or gang violence—or that certain populations are more likely to be victims of crime, cannot itself establish an asylum claim.”

"They don't come to America for any of them reasons listed in the article, it is strictly economic reasons and they have the children to prey on sympathetic people to shelter and roll out the red carpet for them, nobody plays the victim like a latino woman with little kids hanging all over them."

On a slightly different, but related topic, I accidentally clicked on a Fox News article about Anthony Bourdain's suicide two days ago and for some reason, read the comments after the article. I honestly have never read more hateful, lacking-in-compassion comments in my entire life. It's like these right wing rump supporters have had every ounce of humanity sucked out of them. It made me sick but it doesn't surprise me at all that there would be similarly hateful and despicable comments about this recent anti-immigration move. I don't understand how people can feel such a level of disconnection from their fellow humans that inhabit this planet. And of course, the ultimate irony is they are almost always the first ones to call themselves Christians and justify their behavior in the bible and the church.

(CNN) — The Trump administration Monday overturned asylum protections for domestic violence victims in a decision that could affect thousands of asylum seekers from Central America.

The move from Attorney General Jeff Sessions specifically addresses domestic violence victims from Central America and ruled that a 2014 Board of Immigration Appeals decision protecting such women was wrongly decided. But it will have broader implications for any victims of crime or violence in countries that can’t or won’t protect them — a rampant issue in Central America and beyond.

Sessions’ decision sets a high bar for victims of crime to qualify for asylum protections. Not only must the government of the home country be unable or unwilling to help the victims, Sessions ruled, but “the applicant must show that the government condoned the private actions or demonstrated an inability to protect the victims.”

The ruling and announcement is the latest evidence of Sessions taking full advantage of his authority over the immigration courts — a separate court system designed by law to be under the auspices of the Justice Department. The attorney general functions as a one-person Supreme Court in the system, in addition to hiring and evaluating the lower court judges themselves.
