You absolutely can own a weapon if you are not a us citizen. The requirement is that you have to be a permanent resident (green card), a visa is not sufficient.

This guy likely does not have a green card or commited some other crime disqualifying him.

My Canadian friend has a green card and a clean record, so had no problem.
