Kennedy announces retirement from Supreme Court
Source: The Hill
Supreme Court Justice Anthony Kennedy has announced he is retiring after more than 30 years on the court, kicking off what is sure to be a vicious confirmation battle.
He will retire effective July 31.
Kennedy, who turns 82 in July, is the courts longest-serving member and second-oldest justice after its leading liberal, Ruth Bader Ginsburg, who is 85.

Millions couldn't be bothered to get informed let alone get off the ass vote. So this is what they get and they deserve. Sorry that those who are not in the Malania camp and really do care are going to suffer. The only thing that personally affects me is the grand kids and just what kind of future they will have. https://www.yahoo.com/lifestyle/photo-85-year-old-ruth-bader-ginsburg-planking-going-viral-justice-kennedys-scotus-retirement-news-123751787.html
While the news came as a shock to many, its worth noting that, at 81 years old and more than 30 years into his SCOTUS career, Kennedy was already well past the age (63, according to census data) at which the average American retires. And yet the courts go-to swing vote is still two years shy of the projected departure age for Supreme Court justices, which is 83.
Justice Ruth Bader Ginsburg, meanwhile, celebrated her 85th birthday in March and those who fear that a Kennedy replacement appointed by President Trump would sway SCOTUS in conservatives favor are counting on her to stay put. In addition to being the oldest justice, Ginsburg is also one of the most liberal, and her exit before the end of Trumps term would result in a major power shift.
Fans of the Notorious RBG have two reasons to be optimistic that that wont happen. Firstly, Ginsburg is still five years younger than the oldest-ever justice, Oliver Wendell Holmes Jr., who stepped down in 1932 at age 90. Secondly, shes fit as a fiddle at least according to this still from the 2018 RBG documentary.

Pretty much the only hope; bluntly, Justice Ginsburg is not well and is hanging by a thread. Kennedy was a mushy moderate.
If he is replaced and Justice Ginsburg becomes ill or dies, the Supreme Court is lost for 30 years.

Those few in red states up for grabs in November need to stay as far away from a microphone as possible until we figure out whether we can flip a couple moderate Republicans. They need to hold fast until we're certain that we can't win... then they can be let off the leash if it might make the difference in November.

(6,881 posts)History has a way of overthrowing itself. There are a few possible positive scenarios: to energize the midterms (For the left it's do or die), Roberts may move towards Kennedy's position (conservatives already think he's squishy, e.g. ObamaCare), conservatives in Senate may move center (e.g. Romney), Court since Bush v. Gore is now so obviously politicized, it just may be ignored (do they really want to send an army to shut down Planned Parenthood?). As we saw this week, when the dam is broken, they have no idea of the flood they will be up against.
