Missouri court permanently blocks key part of voter photo ID

JEFFERSON CITY, Mo. (AP) The Missouri Supreme Court on Tuesday permanently blocked a central portion of a 2016 voter identification law that it said had required a misleading and contradictory sworn statement from people lacking a photo ID.
The 5-2 ruling upholds a decision by a lower court judge, who had blocked the affidavit requirement from being used in the 2018 general election. It had remained on hold since then.
Missouri is one of several states where Republican-led legislatures have passed voter photo ID laws touted as a means of preventing election fraud. In Missouris case, the state law was accompanied by a constitutional amendment, approved by 63% of voters in November 2016, that authorized the implementation of a photo ID law.
Voter photo ID laws have been opposed by Democrats, who contend they can disenfranchise poor, elderly, disabled and minority voters who are less likely to have photo IDs.

Probably the legislature will pass the law again, and voters will approve it again, just without the confusing language. It was a Republican legislature that passed it. Maybe the legislature will change before they can pass it again.

(22,281 posts)As an election judge I have to be prepared to do this so here goes:
Person appears to vote, and states he/she has no photo ID. We do not ask them why they don't have one, we take their word for it. What they have to bring to the polls is either a utility bill, pay stub, or other official correspondence that was sent to them at the address which is in the voter registry. It has to be something besides the Registration Confirmation card. (we already know the person is registered if they are in the poll book) We have an affadavit which prints up when we check them in, they sign it and we send it to the elections office (there is an envelope for that - there is always an envelope!) Voter gets a copy.
Now if they say they left it at home, or it is at the office or whatever then we send them right out the door to go home and get it. We can let them vote provisionally if there isn't time to do that and then they have to bring their ID to the Elections Office within 5 business days to "cure" the ballot.
This was one of the modifications to our Photo ID rules after the Veasey v Texas case was ruled. It has been a huge help. I have not had to deal with very many of the "have no ID" voters but at least we can let them vote.
The other one was much more significant: before Veasey v Texas, any ID that had been expired for over 60 days could not be accepted. Not so good for the person who quit driving and never bothered to exchange the DL for a State ID. (such as retired Speaker of the House Jim Wright - seriously he was told he could not vote because his license had been expired for more than 60 days. He had quit driving more than 2 years prior.)
After Veasey v Texas, the license/ID can be expired up to 4 years. This did away with a huge number of problems.

(7,405 posts)Free and supportively available picture voter ID, for everyone. That would stop this particular crazy suppression tactic of the republicans.
So, we stop fighting their stupid voter ID law with an all inclusive law.

(22,281 posts)to get it. You had to have a birth certificate or other document proving your citizenship. Lots of old folks around here who can't produce that info because they were born before official birth certificates. Often the only documentation was the family Bible.
However we do have a workaround here: Anyone over 65 can apply for and receive a vote by mail form. Fill it out, send it back and then every ballot for every election for the rest of the year is sent to the voter. No photo ID. If you are on the registry you will get the application and once you return it you are good to go.
AND the Texas Democratic Party has been identifying Democratic voters who qualify for these ballots and sending the applications to them automatically every January. Our Vote by Mail numbers have increased dramatically since this began. Since we do not register by party here, it can be hit or miss with finding everyone but if folks have voted in D primaries, they are on the list.
I used this for a while because I work a precinct different from my own. NOW we have the ability to vote in any precinct on election day so I can vote wherever they send me to work.

(7,671 posts)These journalists need to get educated about election terminology. The ENTIRE future of our planet is hinging on the 2020 election and these reporters and politicians and other officials are clueless as to what the mythical voter fraud is versus rampant election fraud.
They also don't understand what a verifiable ballot is -- it is one that is HAND-marked that you can look at and see whom you have voted for before you cast your ballot (which SHOULD be HAND-counted in an ideal, transparent election).
They also don't understand tabulators -- central tabulators, optical scanners. They also don't understand what a ballot-marking-device is and that it is a touchscreen device that spits out a barcoded paper, not a verifiable ballot which shows voter intent that can be used in the event of a recount,

After we verify the person's ID and registration and sign them in, a barcode is printed with their precinct and ballot form information. This is scanned by a machine which produces the access code to use the actual voting machine, and the voter picks up the blank ballot form. I mean blank, like nothing on it That part comes later.
It is a touch screen, however no information is stored in it. You key in the code, your proper ballot comes up, you make your choices (and review them as many times as you feel you need to), make changes, etc. Once you are certain your ballot is what you want, you press PRINT and you get a ballot which which has a list of your choices, and a scan code. Nothing is stored in this machine either Then you drop the ballot in the scanner. The scanner counts the info via the scan code (looks sort of like a UPC code) (again nothing is stored except the count.)
Viola! we have 100% paper backup combined with the ease of the touch screen
Bonus: using the old paper ballots often caused votes to not count because the voter did not mark the box clearly. This will not happen anymore.
