Tweets, photos, and video of the historic vote today (59-41) in the Virginia House of Delegates to ratify the Equal Rights Amendment making it 38 states, which is whats required, which have ratified the amendment. Of course, the Trump administration and Republicans will fight this in the courts, but still
its an important, historic vote nonetheless. Congratulations to everyone who worked so hard to make this day a reality!

Itll probably be in court for a long time unfortunately.

(4,997 posts)There will be lawsuits from both sides. One the pro side they will be aimed at the states that have rescinded their ratification and on the con side whether or not the deadline embedded in the Amendment text is valid or not.
In both cases Article V is silent. There is no specific language addressing either point. The only thing that Supreme Court has said on this matter is that the extension of the original deadline was moot as the Amendment was not ratified by the original or extended deadline.
My gut says that if/when these get to the Supreme Court, the Court will rule that 1) Just like joining the Union originally, once an amendment has been ratified there is no going back and 2) deadlines are questionable at best because a) the 22nd Amendment took 202 years to get ratified and it stuck and b) the deadline for ratification is a logic bomb for an amendment in that once ratified it the deadline becomes Constitutional but if the deadline passes it can't become Constitutional.
Basically at the end of the day, the Supremes will rule it has been ratified and "Congratulations you are the proud parents of a bouncing baby 28th Amendment. Don't like it? Make another Amendment to rescind it" (and good luck with that).

(15,561 posts)If there really is a god/goddess, please let me live long enough to see this become the 28th amendment. I have wanted this my entire adult life. Now I just want to see it become the law of the land for my daughter and my granddaughter.
