Idaho governor appeals to Supreme Court to stop trans inmate's surgery

A legal battle between the state of Idaho and a transgender inmate seeking to undergo gender- confirmation surgery may be headed to the nations highest court.
Gov. Brad Little announced Thursday that Idaho has appealed to the U.S. Supreme Court to overturn a lower courts ruling requiring the state to pay for inmate Adree Edmos surgery. To deny Edmo sex reassignment surgery, the 9th U.S. Circuit Court of Appeals ruled last year, would constitute a violation of the Eighth Amendment, which protects against cruel and unusual punishment.
The Ninth Circuits decision goes against the text and original meaning of the Eighth Amendment and contradicts more than four decades of Supreme Court precedent, Little said in a statement Thursday. The taxpayers of Idaho should not have to pay for a procedure that is not medically necessary.
Edmos lawyers, however, have repeatedly asserted that the surgery is a medical necessity, a view upheld by the courts. In the eight years since her conviction, she has attempted to self-castrate twice due to her gender dysphoria, which she was first diagnosed with in prison, according to court documents. Gender dysphoria, according to the American Psychiatric Association, involves a conflict between a person's physical or assigned gender and the gender with which he/she/they identify.

(26,045 posts)The SCOTUS let stand a lower-court decision that denial of GCS was not cruel and unusual punishment. Hard to see how their decision this time won't be the same.

(43,393 posts)I find the whole process convoluted. To what extent is dysphoria caused by confinement? Psychiatrists have been granted the legal power and duty to interpret minds for the courts and therefore for the state and the people. The governor doesn't accept that, or at least doesn't want taxpayers to pay for it. Maybe I'm just skeptical of star power lawyers and star power expert witnesses like psychiatrists. The experts and the tests they run are not infallible. Labs when used have been known to make mistakes, and to have less than dedicated personnel at times.

(5,184 posts)are probably wiling to spend several times over the cost of the surgery to uphold their antiquated, manly based attitudes about the modern world. People like them are so behind the times that it is really scary that they are still allowed to breed.

(1,423 posts)That dude was a townie around here and was seriously undercharged. The D.A. eventually went for mercy sentencing. He should have gotten life but many accusers were afraid of him and wouldn't testify.
He's a bad man who stalked local businesses and was/is accused of numerous violent and sexual assaults in restrooms. Even after changes were made to restrooms to accommodate him the criminal behavior continued. One of his specialties was to break the privacy doors on the toilet stalls.
Nothing against normal, law abiding people who have various sexual preferences.
But he just needs to hear a large metal door slamming shut.
