Federal judge mulls contempt charge against Michael Flynn

A federal judge is signaling that he may pursue perjury or contempt charges against former national security adviser Michael Flynn over his effort to abandon an earlier guilty plea to a charge of lying to the FBI.
The Justice Department moved last week to drop the prosecution of Flynn launched by Special Counsel Robert Mueller, but U.S. District Court Judge Emmet Sullivan threw a major stumbling block in front of that effort by announcing that he is appointing a former federal judge to advise the court on how to respond to the governments motion.
Sullivan said hes also asking the retired judge, John Gleeson, to recommend whether Flynn should face a criminal contempt charge for perjuryapparently for declaring under oath at two different court proceedings that he was guilty of lying to the FBI, before he reversed course an January and claimed he had never lied.

(8,077 posts)Very tricksy! He can't have it both ways. Either he lied to the FBI, or he lied to these two judges saying he DID lie to the FBI.

(43,384 posts)THAT will get some attention. Second paragraph, not only to argue against it, but to consider why Flynn should or should not be held in contempt for perjury.
I'm guessing that kind of is on the table when you've sworn both sides. 'Yes I did it'. 'No, I didn't'. Is that what DOJ is saying by reversing the molecules?

(43,384 posts)This whole charade is not just happening in Judge Sullivan's courtroom, it's an attempted hoodwinking of the entire judicial system. Rule of law, matters. Did I read this a.m. that 73 friend of the court briefs are expected in this case?

U.S. District Judge Emmet Sullivan said prosecutors deliberately withheld exculpatory evidence from the defense in the Stevens case, despite repeated instructions and three civil contempt citations.
Prosecutors have a duty to disclose such evidence whether their cases involve a public official, a private citizen or a Guantanamo Bay detainee, Sullivan said.
The ruling is another stain on the Justice Department which was riven with accusations that it had become overly politicized under former President George W. Bush and that it violated peoples rights and bungled high-profile cases.

This is besides the fact that Flynn thinks he should not be charged with contempt for lying to the court, when the crux of his withdrawal argument is 'my guilty plea was a lie'.
At this point, he should just cop to the kennedy assassination, for all the good it will do...at least then he could claim an insanity defense.
(On Edit) Oh and Paul Fucking Manafort was released from federal prison today to home confinement, due to covid 19 concerns. Sure...that was it.

U.S. District Judge Emmet Sullivan on Wednesday suggested he is considering the possibility that President Trumps national security adviser Michael Flynn could be held in criminal contempt for perjury.
Sullivan also tapped a retired federal judge to argue against the Department of Justices (DOJ) motion to drop the criminal prosecution of Flynn.
John Gleeson, who served for 22 years as a judge and served as a federal prosecutor before entering private practice, will serve as an amicus curiae, or friend of the court, in opposition to the DOJs recently adopted position that Flynns case should be dismissed.

(21,447 posts)has publicly commented on the Flynn situation. Paraphrasing, he said that once the judicial branch gets a guilty plea the court must follow up with sentencing. He basically said there is no law or precedence for Flynn's case to be dropped.
Sullivan knows that Flynn is a traitor (dictionary definition) and he isn't going to let Flynn off the hook. I have renewed faith in this case now.
