Trans athlete ban in West Virginia overturned by federal appeals court

A federal appeals court has blocked a West Virginia law that bans transgender girls from participating on a sports team that aligns with their gender identity, saying the state’s law violates Title IX – the federal statute that prohibits sex-based discrimination in schools.

On Tuesday, the Fourth Circuit Court of Appeals ruled that the state’s “Save Women’s Sports Act” could not lawfully be applied to prevent a 13-year-old transgender from participating on her school’s cross country and track team.

The law was first challenged by Becky Pepper-Jackson, a 13-year-old transgender girl who runs track for her middle school. She has identified as a girl and has been taking puberty-blocking medication since she was in third grade.

A lower court judge initially sided with Pepper-Jackson during an injunction, while deciding whether or not the law should take effect. Ultimately, the lower court allowed the law to take effect. The Fourth Circuit said that the lower court erred in making that decision.

This is such a waste of time. The Republicans are only bouncing around their own echo chamber with this.

Granted if someone did lose state title to such an athlete that would be tough for them but losing to a non-trans would hurt just as much. This isn’t costing anyone scholarships either. If you are good enough, schools will recruit to be on their team.

Oh and this blondie hottie all over the place on RW media - forgot her name - was SO traumatized losing to a trans athlete didn’t lose to that person, they tied for fifth.

Calling this child an athlete is probably a stretch.

Those who have experienced middle school track (or any other sport, for that matter) know that 1 in 50 ends up being an athlete.

sincere concerns re: hormonally-induced weight/size/structural advantage (as some argue in much older teens or young adults) should know this is NOT AN ISSUE.

Good on that Federal court and that young wannabe athlete.

6. Here's my idea about situations like this:

Instead of dividing sports competitions by gender, why don't we let each sport pick a handful of NON- gender-based criteria for distinguishing between divisions. E.g., in boxing, divisions are distinguished based on weight; in some sports, height could be a key factor; in other sports, levels of blood oxygenation might or might not play a role – I don't know enough about either sports or physiology to say.

But it seems to me that for most sports, you could identify a handful of easily-measurable criteria that would have more to do with ensuring meaningful competition than what bits of meat the participants happened to have between their legs.
