Trump Lawyer Says Having Political Rival Killed Could Constitute 'Official' Presidential Act

When asked by Justice Sonya Sotomayor during arguments on Thursday if the president deciding “that his rival is a corrupt person and he orders the military — or he orders someone to assassinate him” would constitute an official act subject to immunity, attorney D. John Sauer said it could.

“It would depend on the hypothetical but we can see that could well be an official act,” Sauer told the court.

In another hypothetical, Justice Elena Kagan asked if the president would be immune from prosecution if he sold nuclear secrets to a foreign adversary. Sauer affirmed that the sale was an “official act” the president would need to first be impeached and convicted before he could be prosecuted.

Sauer also claimed under questioning that a president could theoretically be immune from prosecution if he carried out — or attempted to carry out — a coup against the government.

100 percent agree. We HAVE to elect enough reps to increase the Justice number to 13 to match the district numbers. AND enough majority in senate and congress to impeach and prosecute Uncle Thomas.

a blunt way. Mostly a freelance before that. A lot of Shakespeare in Tucson's open air Reid and Himmel Parks theaters. Many oddball plays working in John Gunn's assorted companies over the years in that city.

that they wait to issue the decision until the very last day of the term in June and take the approach of punting back to the appeals court. So maybe by 2035 we can have a decision on whether a President is a god.

I edited this because I forgot that the SC and the GQP believe that god status only applies to GQP Presidents. So they may need more time to figure out how to word salad a decision to make that distinction.

from the sad sack six. I expect the opinion to be issued on the last day of the court's term in June. I expect that decision to send the case all the way back to Chutkin to figure out some idiotic test of what's official or private, then back to the DC circuit, then back to SCOTUS.

If Dems control the WH and Congress, their first order of business should be to expand the court to 13 and appoint a quartet of the youngest, brightest liberals he can find.

I generally like lunatics, helping them get better from physical illness was always a challenge that mostly succeeded a. However, these lunayics are now a threat to our country, our democracy, and (given the direction their lunacy is taking) our very lives. They need to be stopped.

These arguments would be laughable to rational people if they weren't being made in front of a USSC dominated by nutjobs.

If I were making the opposing argument, I might say that ruling in favor of lunacy might get TFG off the hook in the short ter but it would also empower President Biden to buy a high powered rifle and execute all 6 wingnut justices on the USSC with impunity.

That's just how silly these arguments are. The people making them don't seem to realize that.

How can any of Biden's executive orders be overturned if the President doesn't have to obey anyone if he/she believes it is part of the official duties of the President? Just disregard any rulings and/or laws.

Forgive all student loans and medical debt. Raise the cap on social security taxes. Use federal money to pay for all reproductive healthcare. Get rid of fossil fuel subsidies. Etc.

Once you start dropping drones on wedding parties as "lawful" acts against Terrorism, the line separating the foreign adversary from the domestic one becomes blurred. Obviously, for DJT and his ilk, there is no such line. And the Oath of Office does state that it is one's responsibility to "support and defend the Constitution of the United States against all enemies, foreign or domestic." That little loophole is just begging to be exploited. Who determines who is an "enemy" of the Constitution? And if someone is determined to be a enemy of same, what, if any, limits apply to supporting and defending it? Moreover, what actions, if not taken, would constitute dereliction of duty to "support and defend?" I mean, the argument can be made that if one doesn't call for a hit on an enemy of the Constitution, he is negligent and liable for not doing due diligence to fulfill his oath.

Now, it can be argued that it was the intent of the Framers that Congress should determine who is an enemy of the US, which is why they alone were given the authority to declare war. The Framers did not anticipate the complexities of modern times, or the eager cravenness that led Congress to surrender that authority to the President, basically establishing that the Executive can carry out acts of war against anyone he damn well pleases under the extended application of the Authorization of Use of Force. I'm sure they would bleat and protest that there was no intent that it be used domestically, or against American citizens, but that's really a feeble protest. Behold the unintended consequences, which it is the duty of the USSC to mitigate, but who knows what they'll do in the end?

I want it for myself. I want it for every American and I want everyone in this country to do exactly as they please, regardless of unwritten laws, innate decency, and jurisprudence.

The rwnj on the formerly s.c., all of the elected politicians, all of the dark money contributors, all the religious fanatics, all of the enemies of the U.S. are putting all of their money and plots on a guy that isn't even toilet trained.
