Trump Lawyer Says Having Political Rival Killed Could Constitute 'Official' Presidential Act

When asked by Justice Sonya Sotomayor during arguments on Thursday if the president deciding that his rival is a corrupt person and he orders the military or he orders someone to assassinate him would constitute an official act subject to immunity, attorney D. John Sauer said it could.
It would depend on the hypothetical but we can see that could well be an official act, Sauer told the court.
In another hypothetical, Justice Elena Kagan asked if the president would be immune from prosecution if he sold nuclear secrets to a foreign adversary. Sauer affirmed that the sale was an official act the president would need to first be impeached and convicted before he could be prosecuted.
Sauer also claimed under questioning that a president could theoretically be immune from prosecution if he carried out or attempted to carry out a coup against the government.

(4,274 posts)that they wait to issue the decision until the very last day of the term in June and take the approach of punting back to the appeals court. So maybe by 2035 we can have a decision on whether a President is a god.
I edited this because I forgot that the SC and the GQP believe that god status only applies to GQP Presidents. So they may need more time to figure out how to word salad a decision to make that distinction.

from the sad sack six. I expect the opinion to be issued on the last day of the court's term in June. I expect that decision to send the case all the way back to Chutkin to figure out some idiotic test of what's official or private, then back to the DC circuit, then back to SCOTUS.
If Dems control the WH and Congress, their first order of business should be to expand the court to 13 and appoint a quartet of the youngest, brightest liberals he can find.

Forgive all student loans and medical debt. Raise the cap on social security taxes. Use federal money to pay for all reproductive healthcare. Get rid of fossil fuel subsidies. Etc.

(17,216 posts)Once you start dropping drones on wedding parties as "lawful" acts against Terrorism, the line separating the foreign adversary from the domestic one becomes blurred. Obviously, for DJT and his ilk, there is no such line. And the Oath of Office does state that it is one's responsibility to "support and defend the Constitution of the United States against all enemies, foreign or domestic." That little loophole is just begging to be exploited. Who determines who is an "enemy" of the Constitution? And if someone is determined to be a enemy of same, what, if any, limits apply to supporting and defending it? Moreover, what actions, if not taken, would constitute dereliction of duty to "support and defend?" I mean, the argument can be made that if one doesn't call for a hit on an enemy of the Constitution, he is negligent and liable for not doing due diligence to fulfill his oath.
Now, it can be argued that it was the intent of the Framers that Congress should determine who is an enemy of the US, which is why they alone were given the authority to declare war. The Framers did not anticipate the complexities of modern times, or the eager cravenness that led Congress to surrender that authority to the President, basically establishing that the Executive can carry out acts of war against anyone he damn well pleases under the extended application of the Authorization of Use of Force. I'm sure they would bleat and protest that there was no intent that it be used domestically, or against American citizens, but that's really a feeble protest. Behold the unintended consequences, which it is the duty of the USSC to mitigate, but who knows what they'll do in the end?
