Supreme Court declines to block enforcement of age-verification requirements for porn sites

CNN The Supreme Court on Tuesday allowed Texas to enforce age-verification requirements for porn sites, rejecting a request from the adult entertainment industry to block the law on First Amendment grounds.
Texas law requires any website that publishes a substantial amount of content that is harmful to minors to verify the age of users. The challengers said the law also forces adults to identify themselves before accessing pornography, which the groups lawyers said violates access to free speech online.
A trade group representing the adult entertainment industry filed an appeal at the Supreme Court and then asked the court to block the law while that appeal is considered. The underlying appeal is still pending.
The Supreme Court offered no explanation for its decision Tuesday, common for decisions on its emergency docket. There were no noted dissents. The emergency request followed a 2-1 decision last month from the 5th US Circuit Court of Appeals that cited Texas legitimate interest in preventing minors access to pornography and allowed the law to take effect.

(2,460 posts)I can tell you that that type of verification is usually done by having the person enter a credit card number thats then checked to see if its authentic (as you have to be 18 to have a credit card), but no charge made or a minimal transaction fee (usually less than $5) is made. Thats in conjunction with setting up an account with the site. Once done, nothing further is required except for logging in on each visit (i.e. no further charges for age verification).
What these guys have done, requiring you to confirm personal identity at every login is
dangerous. Personally identifying information that is hackable (and data are ALWAYS hackable, no matter how secure you think it is), in a location whose content could be embarrassing for some, used for extortion, etc.? Bad, bad, bad idea.
Of course, what this sounds like to me is Ken Paxton (R-Corrupt Douchebag) leading a religionut (sic) charge to shut down porn sites by indirect means. If they cant directly control what you do in your home/bedroom, the Puritanical bastards will find some other way to control you.
Fucking douchebags.

(1,651 posts)Any laws (proposed or otherwise) such as these are just reactionary and ineffective - just sputterings of a small group of authoritarians that want to demonstrate relevance to a minority.
Regardless, we need to make our vote count. VOTE THEM OUT!

(2,193 posts)Ive run into this a couple of times, most lately with KinkdotCom. I dont remember the company, and I cant check right now because Im on my workplace connection, and I dont want to trigger their blocking routine
Anyway, this new company verifies you by having you send them a picture of your drivers license. I give out personal information far too much, but a photo of what is supposed to be a verified ID to a new company with no track record gives me pause.
I have a paid membership to Kink, so Im going to have to do something
As someone said, the best solution is to use a VPN. I know that works for some sites in Japan that block foreign locations, for some reason
TMI?

(585 posts)due to that fire-in-the-gut. Wonder how many more companies will be leaving Texas in next 3 years.
Leases up, can't get new young new hires due to Texas Laws and women from other areas not coming to lose their rights in Texas.
Not a good place to have new or existing company that can exist in other places...

(1,194 posts)Our forefathers fought for our rights, yet again, another right has been taken away. Free Speech. Even though minors, where does it give the government the right to trample over any PERSON bill of rights?
What if a group of 13 year old protest that their lemonade stand is being denied to sell because it is run by child labors?
What if that same grouo of 13 year old want to learn about porn?
It is something i dont want to have my kids have access to but the government is now entering our homes with this bill to ensure free speech is restricted by age and that is something i dont want either.
Besides, who defines porn?
No where in the bill of rights restriction were placed for persons under 18, but does say people. Last i know, kids are people.

(1 post)doesn't mean it has no merit. There is nothing about either porn or the business model around it that I would support. At least Texas is willing to try to handle this destructive lifestyle in some way.
