Maybe they are trying to set up the dynamic that they can do all the crazy crap they want to win votes from their base with the Judiciary saving them from the consequences by invalidating their awfulness.

"See, we voted for making women second class citizens, but the Wi Supreme Court stopped it. It's their fault!"

Bada bing - they keep getting reelected while facing no real consequences.
