(4,274 posts)if anybody thinks that some of the various many defense lawyers, their clerks, their associates and their investigators aren't having relationships with each other or some of the defendants relatives etc. I have a bridge in Brooklyn to sell you. It goes on all the time every day across the country and usually is no problem. My problem here is the judge, the trier of fact in this matter, holding a private meeting with a potential witness without the lawyers for the two sides being able to hear what is being proffered to the trier of fact. Then the supposed "important to hear from" witness, that was the judge's words, comes to the witness stand and has zilch other than "I don't know".
So somebody wants to apply a yardstick to conduct by parties for the prosecution but we are forbidden from being able to demand that the defense or the judge stand against that same yardstick. Unless everybody stands to that scrutiny then nobody stands to that scrutiny. That is called fair and equitable treatment and expectations and is what is supposed to be the rule in a court.
