I am just finishing writing a non-fiction book about the exercise of discretionary investment authority by financial advisors, and how the SEC and FINRA cloak a financial advisor from disciplinary or prosecutorial action in reliance of DIA, even when the financial advisor has stolen a client's investment portfolio.
For instance, while some know that an investor has a vested right to 100% ownership of the monies in their investment portfolio, few know that the DIA gives the financial advisor 100% control of the monies in a client's investment portfolio -- and that the financial advisor can exercise that DIA control without the knowledge, consent, or approval of the client.
Not every financial advisor will exercise their DIA to include theft, but every financial advisor has the authority to do so.
Virtually all contracts between the client and the financial advisor contains boiler plate language empowering the financial advisor with DIA, allowing the financial advisor to treat the money in their client's investment portfolio as if it was their personal piggy bank.
It will be published before the election.
