Wyoming delayed justice for Rita Humphrey, so 7th District Court Judge Thomas Sullins denied the state the opportunity to try her for the 1977 killing of her husband Jack, he wrote in a decision Thursday.

The dismissal of the first-degree murder case, which was to go to trial Jan. 3, does not mean prosecutors can't bring the case again.

District Attorney Mike Blonigen, who was scheduled to prosecute the case, expressed disappointment in Sullins' decision.

"We felt the law was on our side," Blonigen said.

He is considering appealing Sullins' decision to the Wyoming Supreme Court, he said.

"To me, it remains a pending case, he said.

The Humphrey family was outraged.
