All military personal are subject to the UCMJ, and this dude is in clear violation of that code. Keep in mind this isn't some kid who just joined up, this is a career officer in charge of a major military operation. He knows better and obviously doesn't care.
This will be a very dangerous thing if the military doesn't not take appropriate action in this case. You might as well take the UCMJ and throw it out the window because it won't be worth the paper it's printed on.
