You say: IMO if the act attacks their identity - it is a hate crime, regardless of whatever weird set of stupid or hateful motives was behind it. I also have a problem with the justice system parsing the fine points of someone's motives. Punish the act - which in this case was an attack on the victim's identity. Also, the attack undoubtedly caused fear in the target community, whether or not that was intended.

Do only certain people have 'an identity' that can be attacked? Burning a cross on someone's lawn--is that an attack on their identity? How can you tell? What if it's an X that's burnt instead?
