Impeachment is political, not criminal. Hence the charged official being tried in Congress, not in a court. There is no standard for evidence, no requirement for unanimity among the "jurors". The whole process, from start to finish, is political by definition.

Officials in the past (judges, actually) have been impeached for incompetence and failure to do their duty, which is not a crime. A crime need not be committed if DK can prove they're incompetent for the position. The penalty is removal from office, again not a criminal penalty. They won't be imprisoned if convicted.


To assert that impeachment for a non-crime is "unconstitutional" is to have no idea how the process is actually supposed to work.
