Does Kerry seem kind of sadistic?

When you’re alive and you’re deprived of your freedom each day and you’re in tough circumstances—and I’m talking about tough circumstances. I’m not talking about some cushy situation where they live off the fat of the land in prison. I’m talking about tough."

Also, since Kerry feels the system doesn't work and that incarceration is a worse punishment, why does Kerry want the death penalty for terrorists since he says it's a criminal justice system that kills innocent people? How can he be sure that the terrorist is not innocent?
