Question..about legal action and Dems

I understand that the money Kerry put aside for recount/legal fees can only be used for Democrats and therefore cannont be given to Green party. What I want to know is..since Kerry did not request a recout by the required date, does that mean he can no longer take ANY legal action on the issue in Ohio? I thought Kerry/Edwards had filed a civil suit regarding the vote machine tampering before the recount. Am I wrong on that? If they did file that, was has happened on that? Can they still file actions with new information coming out?
