Montana - Appeal in stun gun case rejected

The state Supreme Court has upheld the conviction of a Bridger man who shocked his girlfriend in the temple with a 600,000-volt stun gun while she was sleeping.

District Judge Blair Jones convicted Lewis Price III of felony assault with a weapon in November 2005 and sentenced him to 40 years in prison.

Court records say Price's girlfriend asked him to leave their house one night in April 2005. He returned hours later wearing camouflage and shocked her.

In his appeal, Price argued that the state violated his due process rights by introducing evidence of other crimes without notice and that the District Court abused its discretion by allowing certain testimony.

The Supreme Court disagreed.
