New Grand Jury in CIA Leak Case Hears From Prosecutor

The CIA leak investigation returned to a more active stage yesterday as a special prosecutor presented information to a grand jury for the first time in six weeks.

Special Counsel Patrick J. Fitzgerald's decision to enlist a new grand jury comes as he continues to investigate possible criminal charges against senior White House adviser Karl Rove. Rove faces possible legal consequences for not telling investigators for months that he had provided information about CIA operative Valerie Plame to Time magazine reporter Matt Cooper in July 2003.

Yesterday was the first time a grand jury has met to consider the case since Oct. 28, when a previous grand jury indicted I. Lewis "Scooter" Libby, Vice President Cheney's chief of staff. Fitzgerald, who arrived with four deputies, an FBI agent and boxes of files, declined to comment on the three-hour session as he left the courthouse. No witnesses were seen entering the grand jury room.

But several legal experts and sources involved in the case said Fitzgerald was probably providing the new grand jury with a primer on what has been learned in the investigation and what remains unresolved. They said the prosecutor's move into a more active probe could spell trouble for Rove, or for other people enmeshed in more recent developments in the case.

Eliason, who headed public corruption prosecutions in the U.S. attorney's office in Washington, said Fitzgerald would not go through the trouble of repeating information to a new grand jury unless he is considering criminal charges or there are significant, potentially criminal matters he wants to resolve.

"The fact that Fitzgerald is going through the effort to re-present is certainly a sign that the investigation is active," Eliason said."

He was working on this case for two years before he gave his first news conference. I'll admit I had reservations about this dude at first but that's gone away.

If one doesn't wish to call it the White House Leak Case, due to the allegations that haven't yet been tried, then isn't it just as inaccurate to suggest the Leak came from the CIA?

as referring to the source of the leak, but as referring to the victim, agent Plame. At least the term "Plamegate" faded.

15. They WILL Indict Rove, you can count on it
I've spent the last year investigating online and researching and during that time I created a 2 DVD set "Rove's War", with the Definitive Chronology of the PlameGate affair, all the goodies from the beginning..

H2OMan, a well respected DU'r reviewed the film, and even watched it three times (yeah, he was snowbound at the time) and sent multiple copies to family and friends, saying that this was an important film to combat the SPIN that was to come, and is coming all the time..

If you want to know HOW, WHERE, WHEN, and WHY it all happened I've got the goods on these guys.

Here's one helpful hint, when this case was first brought up (BY the CIA) Rove was interviewed by the FBI, THEN Ashcroft Recused himself, now if you know Rove like I do and have done the research you can know for sure that he LIED to the FBI in the FIRST PLACE, Frome the Start.. remember, he thought he was Invincible at that point and could say whatever.. well, now Fitzgeral has THOSE INTERVIEWS, it's not just the Cooper outing of Rove's lies, there's LOTS, LOTS more..

Also remember that Letterheads were stolen from the Niger Embassy in Rome in 2000, just about the time Bush was being sworn in, soon in 2001 DEC, Ledeen, Feith (Rove and Cheney's boys) were holding private meetings with the head of the Italian CIA (SISMI) and a KNOWN FORGER.. THese people were all involved with Chablai who was in bed (maybe literally) with Judith Miller.. this is all in the film.

Don't forget that when Rove was a Young Republican HE LITERALLY BROKE IN and STOLE Letterheads from Dixon's office in Chicago, created invitations for Free Beer and a GOOD TIME at Dixon's office and handed them out in Soup Kitchens and in the Red Light District in Chicago (hmmm, isn't Fitz from Chicago? Hasn't he broken the BACK of the Daley Machine there?) -- which means that good old "one trick pony" Rove is repeating the same tricks all over again and again, gaining more power and use each time..

You could effectively wonder if Rove had his own "Plumbers" just like Nixon BREAK into the Niger Embassy in Rome while Bush was first STEALING the WHite House to ramp up FAKE documents as a causus belli for a FAKE WAR later..

It's very stinky and I have it all, plus clips from the Daily Show to spice things up, with wit and Facts that keep the whole documentary flowing, entertaining, informative and educational all in one.

Take a look.. anyone got Fitzgerald's address? I'm thinking of sending him a copy, you never know, might be an angle or single bit of info that might tie something together in the film.

And I'm trying to get copies off to as many Congress folks as possible as well, to use as a tool to fight the SPIN coming from all directions.

I think you'll like what you see :)

would be the crime exactly? Would it be the crime of forgery - but a crime in Niger? That is, aside from the conspiracy to defraud the US.

maybe something Interpol would be interested in.. I mean hey, if that isn't a War Crime then what is? Forging Documents to start a faked war so your pals can get rich?

and Fitz HAS been following that lead, so there must be something he can use or charge Rove with should Rove have "Plumbers" much like Nixxon did.. as I understand it, the FBI isn't limited to THE Continental United States anymore - seems strange to have FBI agents showing up in other countries investigating stuff, like X files crap :)

I HOPE Fitz ties this all together - I better send a copy of my film to him just in case.. you just never know what a person might have pieced together that could make a difference..

I also hope that Fitz has someone monitoring firedoglake as well, that site is the BOMB (oops, not a good cliche to use anymore, eh?) :)

Judy Miller was jailed by a Judge who said there were "Very Serious" issues after viewing documents presented by Fritz. Those documents have always been redacted so no one other than the Special Council and the Judges have seen the material. Yet Fritz has brought no indictments on the original charges. We all know a Covert Operative was outed by the Administration but no charges filed. I am really curious about it. Granted Lying to Grand Jury is a Serious charge but peripheral to the case. IMO what they did borders on TREASON and if they get away with it what will they do next? Our nation is truly at stake here....

25. They Can't Get To The Facts of the Underlying Crime
Because of the obstruction and perjury.

As Fitz put it so eloquently in baseball terms: "They kicked sand into the umps eye", so he's getting them for that now. Hopefully, because of the obstruction and perjury charges, which are pretty serious themselves, some people will sing and we'll get to the bottom of it.

Though I would be willing to bet that Fitz probably has a pretty good idea about what went on regarding the underlying crime, but he just doesn't have a solid case yet because of the obstruction and perjury.

28. Rove could care less. He got his.
With all of the get-out-of-jail-free cards, almost no one is going to end up in jail. The only thing this prosecution will accomplish is sorting out the truth. And I doubt many Americans give a damn about that. I feels good that someone is working for that. For what that is worth.

I would be significantly more excited if there were fear in the hearts of these assholes that they might actually have to pay for their crimes.

It's Fitzmas in a very thin and figurative way. For me. I sure hope I'm missing something, and am wrong.

They have been throwing sand in Patrick Fitzgerald's eyes for the past two years. If they were not afraid of what he could ultimately find them guilty of, they would not have obstructed and obfuscated, lawyered up, spent their days spinning whatever teeny bits of information come out of the investigation or sent their talking heads on any news program they could find to attempt to undermine the Special Prosecutor's investigation.

Of course, this is IMHO. I could be wrong. At the same time, I'm thinking that pardons of any of these clowns will politically damage * and his little friends so badly for the next 20 years that it wouldn't be prudent.

"Time magazine disclosed on Nov. 27 that one of its reporters, Viveca Novak, would soon answer Fitzgerald's questions about conversations she had with Rove attorney Robert Luskin in 2004. Sources familiar with the case said Luskin told Fitzgerald in October that those conversations would help buttress Luskin's argument that Rove did not intentionally conceal his contacts with reporters from the grand jury."

33. I think that depends on who is talking. I watched KO tonight and Larry
O' Donnell? seemed to think that Novak was Rove's get
out of jail free card not necessarily because of her involvement but because she "tipped" Luskin off about
Cooper being involved which may have set the wheels in motion for Rove to "correct" his previous testimony.
Novack says she told Lusking about Cooper because she was "sure he already knew" about Rove being Cooper's source. The whole thing stinks like week old mackerel.
I hope that Fitzgerald has something up his sleeve and knows something they don't know.
