Senate leaders to question Alito about president's war powers
--------------
CAPITOL HILL The controversy over President Bush's defense of domestic spying without warrants is spilling over to the Supreme Court confirmation process.

Senators say high court nominee Samuel Alito will have to answer questions about how he views the president's powers in the war on terror.

Senate Judiciary Chairman Arlen Specter and ranking Democrat Patrick Leahy have sent separate letters to Alito. The senators say they'll ask about the president's authority to order warrantless spying at Alito's confirmation hearings.

Bush says warrantless spying, conducted by the National Security Agency, is an essential element in the war on terror. The president says the Constitution gives him the authority to order the warrantless monitoring of phone calls and e-mails of individuals in this country believed to be plotting with terrorists overseas.

4. I have to go to the store to get more popcorn
The only thing better than all of this would be an indictment of Rove by Fitzpatrick.

I am praying for Bush's impeachment!

The thing about Alito is that he presents himself as a "strict constructionist." How in the Hell is he going to say that Bush has powers not explicitly stated in the Constitution and still pass himself off as a strict constructionist?

3. This should be good for a few pounds
of popcorn! I was cruising around the transcript from the 12-19 press briefing and Alfredo G. has some mighty interesting gems of legal reasoning that he is trying to shop to us American people. I cannot imagine how Alito will dance his way through that minefield.

5. OMG. Is there real oversight on the agenda again?
Whatever the motivation, it’s long overdue. Even with a total house cleaning it will take years to dig us out of the hole the * regime has dug for the people and our democracy.
