Supreme Court of Canada says OK to swingers clubs with group sex, swapping

Swingers clubs which feature consenting adults cavorting in twosomes, threesomes and moresomes, are legal, the Supreme Court of Canada said Wednesday.

In a major decision, the court re-wrote the definition of indecency to use harm, rather than community standards, as the key yardstick. The 7-2 majority ruling, written by Chief Justice Beverley McLachlin, said indecent acts must be shown to be harmful to the point where they "interfere with the proper functioning of society."

didn't they hang witches in salem over "community standards" and lynch people for being the wrong color in the south (and parts of the north) over "community standards"?

I don't see what's so great about community standards anyway. By nature community standards pander to the people who want the restrictions they place on themselves to apply to everyone else.

A law cannot be a law without enforcement. A standard is just a suggestion. It's best to keep them separate.

From some interviews I've read, it seems like people who are really into group sex are people who have few other things about themselves that are interesting. I really wonder who would want to have sex with some of those people. If you are going to have sex in public, you would think the person would try not to be a lardass.

have only read about once or twice.

Having done the swing scene in Canada, NY, NV, CA and NM. I can tell you that you are only partially right. Some of these places have screening programs that rival a nuclear facilities. However there are some bad low down places out there that dont seem to be able to attract female participation because of the fact taht they are low down. Mostly they just turn into circle jerks.

The places I have become a member of demanded disease free passes ala verified check ups. No woman I ever met at any of these places was some meek battered wife like you just tried to imply. Quite the opposite in fact as most of them were Doms or switches. Trust me no one tells a Dom what to do.

As far as blackmail goes... well if you are high powered enough to make yourself such a target, you run that risk no matter what and how you go about it.

The people I have met in clubs have been all shapes and sizes but your comment up thread speaks volume at the shallowness of your knowledge not only on the subject of swingers and the places they frequent but your predisposition to be intolerant and not understanding a single thing on the subject at hand.

Finally all your snarky bitterness aside. The manner with which you provided debate was so not Liberal or progressive and indeed came off as authoritarian in nature of which you are most definitely not (an authority on this subject). As you go through life playing up stereotypes and ill begotten imagery of situations you have no idea about please refer to this poem.

They are just NORMAL folks - who do not wish to be monogomous, but don't "cheat" either.

The couple that runs the local swing club here are really nice.

44. Swinging is far more common than most people think.
Very few people go to swing clubs, but MANY people allow their other married partner to have sex with other people. My wife is bi and has a regular girlfriend. Many other people have consensual affairs, where one partner lets the other cheat without mentioning it, which is really nothing more than a different form of swinging. Many other people have participated in threesomes with their married partners (another form of swinging).

When you total up all of the various facets of voluntary non-monogamous marriage, some surveys put the number of couples that participate in all the forms of swinging at over 20% of the population. Some do it once, some do it regularly, but it's far from rare.

Its not for me, but I don't judge anyone who does this...Hey, if its between consenting adults over 18 and no one is getting hurt, why should any of us care?

Hey, I'm in Canada right now....I laughed when I read about this in the papers here...most Canucks here don't care one way or the other....It seems to be a bigger deal on all the American Blogs and News Media (including surveys on the various news websites). I'm sure that Rick Santorum is already planning his speech on how the neighbors to the North are one step closer to Man on Dog Sex Clubs and Tucker Carlson is preparing his next insulting rant on Canada.

Sex in a public place for a party is totally legal. However I believe there is something on the books about sex outside of marriage.

Many of the states however do have laws against penetration in a public facility, some are linked to liquor liscenses and other states just have "community standards" type of laws.

The Dem mayor there is on some sort of weird morality crusade. Anti video games, sex shops, clubs, etc. If what happened in Canada were to happen here (yah, right, i know) in the US it would likely overturn local bans like the one in Indianapolis.

I REALLY don't think consensual sex between adults messes up anyone. What messes up people is a lack of honesty in a relationship. I.E. cheating and sneaking around behind your partners back.

In a ruling that radically changes the way courts determine what poses a threat to the population, the top court threw out the conviction of a Montreal man who ran a club where members could have group sex in a private room behind locked doors.

"Consensual conduct behind code-locked doors can hardly be supposed to jeopardize a society as vigorous and tolerant as Canadian society," said the opinion of the 7-2 majority, written by Chief Justice Beverley McLachlin.

61. It's a step forward to define "indecency" to use harm, rather than
"community standards" (an arbitrary "standard" to begin with), as community standards, for legal purposes, reflect the law anyway (no stealing, etc) - regardless of how individuals "define" it and apply it to themselves and their homogeneous neighborhoods.Your opinion of what is "moral" is NOT the community standard and neither is your place of worship. No matter how much you may want it to be so or how much those institutions want it to be so.

I applaud this decision.

to ANY Canadian farmers along the US/Canada border. If you see ANY PNAC conservative American politicians in your neighborhood, PLEASE guard your herd animals vigilantly. No one knows how those "family - oriented religious" whack jobs will interpret that law...
