Domestic violence law excludes some
Appeals court rules law does not apply to people living together

DAYTON | County prosecutors cannot charge some unmarried people under Ohio's domestic violence law because it conflicts with the state constitutional amendment banning gay marriage, this area's state appeals court ruled Friday.

The 2nd District Court of Appeals is the first of the state's 12 appellate courts to rule that the domestic violence law runs afoul of the Defense of Marriage amendment, passed by voters in 2004, and does not apply to "a person living as a spouse."

The appeals court upheld dismissal of a domestic violence charge against Karen S. Ward of Fairborn, charged with assaulting her "live-in boyfriend" in Greene County,

The ruling affects domestic violence cases in Champaign, Clark, Darke, Miami and Montgomery counties as well, Greene County First Assistant Prosecutor Suzanne Schmidt said.

Holy crap. Ohio overturned part of its domestic violence law by passing the anti-gay and anti-gay-marriage Defense of Marriage Act.

Get the word out to every state considering one of these. The religious right's bigotry has just turned around and hurt women. That's what happens when you cave to these bigots.

1. They won't care (at least the fundies who passed the law
won't). After all, if you're "living together", you are "living in sin" and therefore shouldn't be protected by the law anyway, right? Assholes.

2. This is the problem with passing laws like this...
once again the neocon wingnuts hastily passed a law that handcuffs (pardon the pun) the police and courts. When enough domestic disturbances end in death from unmarried spouses the law will change.....when one of their own kids or family members is directly impacted by it...it will change....sigh....

We have to take fifteen steps back to move 5 steps forward.....dumbasses...

3. You think fundies care about gay people getting killed?
They'll probably say "They had it coming to them. Punishment for their sin" or something like that. You wait and see!

5. Actually, I meant that gays getting harmed does not seem to
be much of a concern of fundies. But, then, of course, any hetero couple "living in sin" has to pay for their sin.

7. this is exactly the type of thing that happens when you....
... take away a person's rights. Yes, the fundies will say that "they deserve it" but, hopefully, more people will catch a glimmer of what it means to revoke people's rights through things like this. Just look what's happening in South Dakota. The right wingnuts are going to have a tough time answering the question - to their constituents and their donors - "do you support an abortion ban like South Dakota's?" It's a simple yes or no question - 'No' loses the base, 'Yes' loses everybody else. As these things come home to roost, the base support will become less and less useful
