Mother sues hospital for letting son die ("waiting for Medicaid coverage")
The mother of a man who died after being delayed for surgery is suing the Manhattan hospital that "let him die," the New York Post reports.

Levia Prieto is seeking punitive damages for the wrongful death of her son, Manny Lanza, from the hospital as well as the three doctors who treated him. Lanza died two months after his surgery to relieve the swelling of his brain vessels was delayed.

According to St. Luke's-Roosevelt Hospital's records, Lanza was waiting for Medicaid coverage to cover the cost of the surgery.

The Post reports St. Luke's has denied holding treatment from Lanza, saying its staff, "met the highest standards of medical ethics and clinical competence."

1. She should be suing the disgusting HMO...
that withheld the coverage. You can't have medicaid without belonging to an HMO.

2. Isn't it Medicare that requires an HMO? ...
Medicaid is for the "poor" , not retirees

10. I have medicaid and I have to go through an HMO.
Used to be you didn't have to but now they force you into it and if you don't choose one, they choose it for you.

7. Neither Medicaid nor Medicare
require an HMO according to federal rules.

Individual states may require a Medicaid recipient to be a member of an HMO -- but the same does not hold true for Medicare, for which Fee For Service is still universally available.

9. She should also sue the Medicaid office that took so long to
okay MA when it was an emergency. As I remember it workers have 45 days to finish and application process.
