Deliberations in the Liberty City Six terrorism trial were stalled
again after a juror decided she is unwilling to participate with
others on the 12-member panel.
A juror at odds with 11 others deciding the fate of six men charged in a Miami terrorism conspiracy said Monday she isn't willing to deliberate further because the other jurors are making her sick to her stomach.

''I'm really unwilling because I'm making myself very ill,'' testified Juror No. 4, who didn't show up for deliberations early Monday because of a ``stomach virus.''
''I'm not agreeing with what some of the other jurors are saying and they're holding that against me,'' she said outside the other jurors' presence. ``To me, all the negativity is directed at me.''

U.S. District Judge Joan Lenard asked the juror, a black woman whose name has not been made public, to come to the courtroom to answer questions about her willingness to follow the law and apply it to the evidence in the case after fellow jurors accused the woman of refusing to deliberate. The incident caused the second, unrelated delay in deliberations, which began on April 27.
Lenard said she will make her decision Tuesday on whether to remove the juror and let the remaining 11 continue deliberations, or replace her with an alternate and have a 12-member jury start anew.

1. It sounds like she's not just holding out, she refuses
to talk about her opinion and explain why she thinks these folks are innocent. IOW, she might just be against the prosecution because she doesn't like the government and for no other reason.

2. This is the 3rd attempt for this Bush farce. Undoubtedly the jurors were pressured
to give them the results they've been seeking over the last 2 years or however long it has been, with this atrociously rigged attempt to prove secret "Islamic" plots to destroy the country in random acts of terrorism.

The first two trials fell flat on their faces, yet the previous administration felt obsessed with driving this through again and again until they got the result they wanted.

When one of the people they dragged into this was acquited in the last skirmish, the Bush administration set things in motion to deport him to Haiti, even when there was a complete lack of evidence to consider trying him again. How dirty can one right-wing collection of sinister clowns posturing as an administration get, anyway?

The one juror who is holding out clearly agrees with the PAST TWO JURIES, yet is being portrayed as a general #### up. Pathetic.

I saw this article overnight, and felt it was too, too damned depressing, and a real victory for right-wing racists. One way or another, it appears they're finally going to be able to coerce that "guilty" determination they have been seeking for years since they conspired to entrap these young, poor men, some of them immigrants, by luring them with promises of quick money, cars, clothing, cameras, etc. by placing an FBI provocateur/informant among them to coach them, and lead them to say they would blow up the Sears Building even though they had no idea where it was or how to get there.

Jury Requested That Juror No. 4 Be Replaced
They Claimed She Was Disruptive & Not Taking Part In Deliberations

MIAMI (CBS4) ―
An uncooperative juror in the "Liberty City Six" terrorism conspiracy case who was described as being disruptive, and offensive has been replaced.

The juror in question, juror No. 4, did not report for deliberations Monday as required, and instead told court personnel she was ill with a stomach virus. Defense attorneys said they believe the illness was actually a ruse to avoid further deliberations.

U.S. District Judge Joan Lenard replaced the juror Tuesday morning and said the juror had violated her duty by refusing to deliberate and casting doubt on the law.

This trial is the third for the six men following two previous mistrials. They were arrested in June 2006 on charges of plotting with al Qaeda to blow up Chicago's Sears Tower, New York's Empire State Building, and Miami's U.S. courthouses and FBI offices in hopes of starting an anti-government insurrection. The plan never got beyond the discussion stage and the group never obtained any weaponry or explosives necessary for such attacks.

Defense attorneys contend the six men were just "dirt poor" men who pretended to be terrorists or supporters to scam $50,000 from two men they thought were working for Osama Bin Laden. The group's leader, 35-year-old Narseal Batiste, testified that he only went along with terrorism discussions because he wanted money from an FBI informant posing as an al Qaeda operative. Defense attorneys also claim the men were entrapped by an overzealous FBI.
